Domestic incident leads to felony charge

A 23-year-old Falls City man will appear in Richardson County Court March 6 on a felony charge of strangulation, stemming from an alleged domestic incident Jan. 4.

According to the arrest affidavit, James N. Cherry allegedly grabbed his wife, Jackie R. Cherry, around the neck with both hands and choked her to the point she couldn’t breathe. Mrs. Cherry told Falls City Police Officers Patrick Stamper and Duane Armbruster that her husband also repeatedly pushed her to the floor and or the ground. The officers noted red marks and bruising upon Mrs. Cherry’s arms and knees.

Richardson County Sheriff Randy Houser within an hour discovered Mr. Cherry at a residence in Humboldt and he voluntarily accompanied Houser to the FCPD for questioning.

A preliminary hearing is scheduled for 1:30 p.m. Wednesday, March 6. A Class IV Felony carries a maximum penalty of five years imprisonment, a $10,000 fine, or both. There is no minimum sentence.
